Terms of Service

1. About MilaPay
MilaPay is a customer, payment tracking and WhatsApp follow-up tool for small businesses. The service helps business users record customers, transactions, payment status, reminders, customer notes and message templates.
2. Who provides the service
MilaPay is provided by Impembelelo Solutions (Pty) Ltd, registration number 2021/972518/07, with its principal place of business at 222 Smit Street, Braamfontein, Johannesburg, 2000. References to "MilaPay", "we", "us" and "our" mean Impembelelo Solutions (Pty) Ltd trading as MilaPay.
3. Your account
You must provide accurate account, business and contact information. You are responsible for keeping your login details secure and for all activity under your account.
4. Customer information you add
You remain responsible for the customer information you upload or record in MilaPay, including names, phone numbers, birthdays, payment records, notes, appointment details and communication history. You confirm that you have the required permission, consent or lawful basis to use that information for payment tracking, reminders and customer communication.
5. WhatsApp and messaging
MilaPay may help you generate pre-filled WhatsApp messages, reminders, receipts, check-ins, birthday messages and promotional messages. You are responsible for the content you send, the customers you send it to, and whether the message is allowed under applicable law and platform rules.
Promotional or broadcast messages should only be sent to customers who have agreed to receive them or where you have another lawful basis. You should identify your business and provide a simple way to opt out.
6. Payments and third-party providers
MilaPay may allow you to store payment instructions or generate links through third-party providers such as Yoco, PayFast, banks or payment platforms. We are not a bank and do not guarantee that a customer has paid unless a supported provider confirms the payment or you manually verify it.
7. Subscription and billing
MilaPay may offer free, trial and paid plans. Paid plans are billed in advance according to the pricing displayed when you subscribe. You may cancel according to the Refund & Cancellation Policy.
8. Acceptable use
You may not use MilaPay for spam, fraud, harassment, illegal activity, misleading payment requests, unlawful marketing, impersonation, or any activity that harms customers, other users or MilaPay.
9. Availability and changes
We aim to keep MilaPay available and reliable, but we do not guarantee uninterrupted access. We may improve, change, suspend or discontinue parts of the service where reasonably necessary.
10. Limitation of liability
To the maximum extent allowed by law, MilaPay is not liable for indirect, special or consequential losses, lost profits, missed collections, lost customers or business interruption arising from your use of the service.
11. Termination
We may suspend or terminate access if you breach these Terms, misuse the service, fail to pay fees, create security risk, or use MilaPay in a way that may expose us, users or customers to harm.
12. Governing law
These Terms are governed by the laws of the Republic of South Africa.
